SPECIAL MEETING OF COUNCIL

April 28, 2004


The meeting was called to order by the Warden at 6:30 p.m., in the Conference Room, in the Administrative Centre, in Barrington, N.S., with the following members present:

- Warden Sterling Belliveau

The meeting was convened by the Warden and notice was given to councillors at the Council meeting held on Monday, April 26, 2004.

Pursuant to Section 19(3) of the Municipal Government Act, the Special Council Meeting was convened to discuss the construction of a new school on municipal property on Sherose Island.  Mr. Paul MacLellan from the Nova Scotia Department of Education was invited to attend the meeting for the purpose of this discussion.
 

SOUTH WEST SHORE DEVELOPMENT AUTHORITY MEETING

Prior to discussion of the proposed school on Sherose Island, the Warden asked members to determine who would attend a meeting of the South West Shore Development Authority to be held at 10:00 a.m., on May 6, 2004, in the Authority’s offices, in Yarmouth.  The purpose of this meeting was to discuss “bridge financing”.  The Warden indicated that he may be working at that time and probably would not be able to attend the meeting.

SCHOOL DISCUSSION

There then followed some discussion of the construction of the school on Sherose Island.  

A map has been received for the property on Sherose Island on which the school will be built.  

Council members discussed the location of sewer and water lines and how these may affect the location of the soccer field on the island.  There was also some discussion on the roadway and the re-grading of the roadway entering Municipal property on the Island.  

At 7:04 p.m. the Council Meeting was adjourned for the interim in order to allow for the conduct of a Finance and Administration Committee meeting.

At 8:07 p.m. the Special Council Meeting was reconvened.  

At this time Mr. Paul MacLellan from the Nova Scotia Department of Education joined the meeting and the discussion.

It was suggested to Mr. MacLellan that the Municipality could turn the water system and sewer system at Sherose Island over to the District School Board for their operation, providing the School Board would allow the Municipality to maintain the connection to municipal buildings.  Mr. MacLellan indicated that he did not believe the School Board would accept the sewer and water systems as they do not wish to be responsible for the running of these systems.  

Mr. MacLellan indicated the Department of Transportation & Public Works is evaluating the cost of the sewer and water systems and will further evaluate other sites, if necessary, if sewer and water are not available at this site.  He also indicated that the Department of Transportation & Public Works would install a new well at their cost.  Mr. MacLellan indicated that it would be better for the School Board to have someone else provide the sewer and water systems and that the School Board would pay operating fees for the sewer and water system.  

It was indicated to Mr. MacLellan that Council cannot make a decision regarding the sewer and water without knowing the expected capital and operating costs of these systems.  

Mr. MacLellan indicated that it is estimated the school will put approximately 4000 to 6000 gallons of sewage per day into the sewer system.  The sewer system is currently designed to accommodate 12,500 gallons per day.  

Mr. MacLellan also indicated that it is the practice of the School Board not to charge back the cost of bottled water being supplied to schools, to the municipal units who are providing the services.  

There then followed some discussion regarding the access road to municipal property.  Mr. MacLellan indicated the School Board was not planning to provide an access road to the municipal property located below the school property or near the shore line.  He then further stated that the Province is committed to providing some kind of engineered access to that property for the Municipality.  

It was indicated to Mr. MacLellan that the boundary lines of the property the province wished to obtain were too close to the Arena.  Mr. MacLellan stated that the property line at the back of the Arena is 60 feet from the Arena, although it had previously been stated by Councillor Atkinson that he had measured this property line to be 33 feet from the Arena.  

Mr. MacLellan indicated that the entrance road to the municipal property would be re-graded so that the slope is satisfactory for school bus traffic.  He also indicated that the Province would “look at” the recapping and widening of the road on Municipal property as far as the school location. 

Mr. MacLellan inferred that there was a “misunderstanding” regarding the provision of a serviced site because department personnel believed that a serviced site would be provided by the Municipality.  The sewer study is currently being conducted by the Department of Transportation and Public Works and this will identify the upgrading that is required for the sewer system and the associated costs.

There then followed some discussion again regarding the property lines and the distance from Municipal buildings and Municipal property.  Mr. MacLellan indicated he would send drawings of the proposed area which the province wishes to obtain.  These drawings will show the dimensions that are currently being proposed.  Mr. MacLellan suggested that Council should send back these drawings specifying the separation distances required by the Municipality.  

Mr. MacLellan then provided a drawing indicating the number of parking spaces that could be obtained between the soccer field and the baseball field.  In two locations the parking spaces shown on the drawing indicated 100 spaces could be obtained for parking in this area.  

There then followed some discussion regarding the moving of the soccer field.  Mr. MacLellan indicated that the Province was very reluctant to move the soccer field because of the archeological issues on the property behind the school, and also because of the estimated extra cost required to do so.  Mr. MacLellan also indicated that the water and sewer lines that are presently located under the soccer field must be addressed before building a soccer field on this property.  He also indicated that the soccer field would be fenced.  

It was indicated to Mr. MacLellan that items 1 and 4 in the letter from the Minister had been agreed to by Council at their meeting on Monday night, and a letter would be sent to the Minister indicating this.  Items 2 and 3 in the same letter would not be addressed by Council until a report on the estimated cost of upgrading the sewer system was received by Council.  

At approximately 9:15, after being thanked by Council, Mr. MacLellan retired from the meeting.

There then followed some discussion of the cost of upgrading the sewer system and the additional operating costs needed to be recovered from the School Board.

It was the general consensus of members that before any further decisions could be made, the sewer study being conducted by the Department of Transportation and Public Works must be obtained.
