Minutes of the Regular Meeting of the Barrington Municipal Council held in the Council Chambers, in the Administrative Centre, in Barrington, N.S., on Wednesday, August 27, 2003.

The meeting was called to order by the Warden at 7:00 p.m. with the following members present:

- Warden Sterling Belliveau
- Deputy Warden Eddie Nickerson
- Councillor Angus Atkinson
- Councillor Louise Halliday
- Councillor Dwayne Hunt
- Councillor Wayne Smith

Absent was Councillor Fred Bower due to work commitments.

APPROVAL OF MINUTES

Moved by D. Hunt and seconded by L. Halliday that minutes of Council meetings held August 13th and August 18th, 2003 be approved as circulated.

Motion carried.
 

BARRINGTON/BARRINGTON PASSAGE SEWER UPGRADE

Mr. Mike Topley of Horner Associates Limited appeared before the meeting.  He informed members that tenders have been called for a new clarifier which is Phase I of the Barrington/Barrington Passage Sewer Upgrade.  He informed members that two (2) tenders have been received for the project.  Mr. Topley opened the tenders and provided tender information to members. 

Tenders were received from the following:

Amber Contracting Limited   $473,500 30 weeks from award of tender

Santec Construction Managers Limited $800,000 48 weeks to complete

Mr. Topley informed members that Santec Construction Managers Limited has requested, by fax, that their tender amount be reduced by $110,000, resulting in a bid of $690,000 for the project.

Resolution C030827

Moved by D. Hunt and seconded by L. Halliday that the tenders for Phase I of the Barrington/Barrington Passage Sewer Upgrade received and opened tonight be forwarded to Horner Associates Limited, the engineering company acting on behalf of the Municipality and the engineers be authorized to review the tenders and award the tender to the company that submitted the lowest tender and met all requirements of the tender.

Mr. Topley was then thanked for appearing before the meeting and presenting the tenders for Phase I of the Barrington/Barrington Passage Sewer Upgrade.
 

CORRESPONDENCE

Insurance Re: Search & Rescue Vehicles

It was reported that the following municipal units in the county have agreed to make a contribution towards the cost of insurance for the Barrington Ground Search & Rescue vehicles.

 - Town of Clark’s Harbour  - $184.00 (paid)
 - Municipality of Shelburne  - $200.00 (paid)
 - Town of Shelburne  - $150.00 (to be paid in October)

Moved by D. Hunt and seconded by E. Nickerson that a letter of thanks be forwarded to the municipal units providing a contribution towards the cost of insurance for Search & Rescue vehicles.

El Paso Canada Pipeline

It was reported that information has been received from El Paso Canada Pipeline providing an update on the project.  In advance to the meeting this information was copied and circulated to members.
 

REPORT OF WARDEN

The Warden informed members that the next meeting of the UNSM Conference Planning Committee is scheduled to be held on September 3, 2003.  The meeting will be attended by the Warden and Councillor Halliday.

Waterfront Development Committee

Deputy Warden Nickerson provided a brief report on the Waterfront Development Committee meeting held August 20, 2003.

Finance and Administration Committee

Fire Department Tax Bill

Conflict of Interest

Councillor Dwayne Hunt declared conflict of interest, vacated his seat and proceeded to the spectator area.  Councillor Hunt is a member of the Island and Barrington Passage Volunteer Fire Department.

It was reported that the Island and Barrington Passage Volunteer Fire Department received a tax bill for property they own in Centreville.  This tax bill was for the interim period between the time the property was purchased and the time it began to be used for fire department purposes.

Moved by E. Nickerson and seconded by L. Halliday that a grant in the amount of $102.60, equal to the taxes outstanding on the Island and Barrington Passage Volunteer Fire Department property, be given to the fire department for the purpose of paying these taxes.

Motion carried.

Councillor Hunt then returned to the table.

Community Grant Request

Resolution C030830

Moved by E. Nickerson and seconded by D. Hunt that a grant of $1,000.00 be provided from the District 6 Community Grant Fund, to the Seaside Cemetery Club, for the purpose of purchasing a barn to house their maintenance equipment.

Motion carried.

B.M.H.S.

Councillor Louise Halliday reported on a recent meeting of the S.S.C. Committee.  She informed members that an advertisement has been placed in the Halifax Herald and the Coast Guard Newspaper inviting landowners to submit proposals for possible sites for the new school.  The next meeting of the S.S.C. Committee is scheduled to be held on September 4, 2003.

Centreville Church Preservation Society

Resolution C020831

Moved by D. Hunt and seconded by L. Halliday that a letter be forwarded to the Centreville Church Preservation Society informing them that their request does not meet the criteria of the Community Grants Policy and that a copy of the policy be forwarded along with the letter.

Stoney Island Cemetery Club

Resolution C020832

Moved by D. Hunt and seconded by W. Smith that the Stoney Island Cemetery Club be granted $1,500.00 from the District 5 Community Grants Fund to assist with repairs to the Stoney Island Community Hall.

Continuation of Second Reading of Snow and Ice Removal By-Law

It was reported that the Snow and Ice Removal By-Law was referred to the August 25, 2003 Finance and Administration Committee Meeting for further consideration.  The matter was discussed in detail but no recommendation was forthcoming from the meeting.

The Chairman of the Finance and Administration Committee read the by-law for clarification purposes.

Moved by L. Halliday and seconded by W. Smith that proposed By-law No. 33 “Snow and Ice Removal By-Law” be approved in second and final reading.

Upon request, the division was recorded.

It was agreed by members that the matter of snow and ice removal from the sidewalks in Barrington Passage be placed on the agenda for the next Public Works Committee meeting.

Second Reading - Local Improvement By-Law

It was reported that at the last meeting of Council question was raised regarding Section 3(5) of the by-law.  At that time it was agreed that legal advice be obtained on this section.  No response has yet been received from the Municipal Solicitor.

Moved by D. Hunt and seconded by L. Halliday that second reading of the proposed Local Improvement By-Law be deferred to the next meeting of Council.

VISITOR INFORMATION CENTRE

Correspondence has now been received from the Municipality of Argyle advising that they are unable to provide inspection services for the Visitor Information Centre Project.
 

POLICY NO. 30 “POLICY TO ELIMINATE CONFLICT OF INTEREST REGARDING MUNICIPAL CAPITAL PROJECTS” 

Notice of Consideration of amendments to Policy No. 30 was given at the last meeting of Council.  It is proposed that Policy No. 30 “Policy to Eliminate Conflict of Interest Regarding Municipal Capital Projects” be amended as follows:

 - Paragraph 1, Line 2, the words “attempt to” be inserted between the words “to” and           “engage”. 

 The new paragraph will read as follows: “In order to eliminate conflict of interest, or perceived conflict, it shall be the policy of the Municipal Council, when any major capital projects are being undertaken, to attempt to engage the services of an independent, outside Building Inspector.”

 - It is further proposed that a new paragraph #3 be added which reads as follows: 

 “In the case that no satisfactory independent outside Building Inspector is available the Building Inspector employed by the Municipality shall conduct inspections as required and issue such permits at his discretion as may be required.”

Conflict of Interest

Councillor Wayne Smith declared conflict of interest, vacated his seat and proceeded to the spectator area.

Councillor Smith is a resident of Cat Rock Drive.

Councillor Smith returned to the meeting.

Snow Removal - Recreation Complex

  - D.M. Snow Contracting Ltd.

It was noted that the tender stated that they will ensure plowing will take place immediately after each snowstorm and will be carried out as per specifications and drawings, excluding Item #5.

Item #5 of the tender documents reads as follows: “When conditions are questionable as to plowing and salting Municipal authorities shall be contacted for a decision.”

Moved by D. Hunt and seconded by W. Smith that Brannen’s Electric Service Limited be awarded a one (1) year contract for electrical services.

Moved by D. Hunt and seconded by L. Halliday that Municipal Staff advertise for Sewer Lateral Installations, Snow Removal Barrington Passage Sidewalks and Miscellaneous Carpentry work.

Motion defeated.

Resolution C030837

Moved by E. Nickerson and seconded by D. Hunt that an advertisement be placed in the Coast Guard Newspaper inviting tenders for the clearance of snow and ice from the Barrington Passage sidewalk.

Motion carried.
 

CLOSED SESSION OF COUNCIL

At this time a Closed Session of Council was held to deal with a personnel matter and possible purchase of property.

The regular council meeting was called back to order.
 

YEARLY INCREMENT - KARL LAMROCK

Resolution C030838

Moved by W. Smith and seconded D. Hunt that Karl Lamrock receive his annual increment after having successfully completed another year of employment with the Municipality of Barrington.

Motion carried.

Conflict of Interest

Councillor Dwayne Hunt declared conflict of interest, vacated his seat and proceeded to the spectator area.

Councillor Hunt is a member of the Island and Barrington Passage Volunteer Fire Department.

Resolution C030839

Moved by E. Nickerson and seconded by W. Smith that the Municipality of Barrington commence the legal process to purchase the former Barrington Passage Fire Hall and land at a price of $65,000.00, plus legal fees.

Motion carried.
